Why Spousal Open Work Permit?

The flexibility of a spousal work permit is much more advanced as it allows Canadian student to invite their spouses to come and live in Canada. It even becomes interesting when the spouses are eligible for a work permit as they can be working and supporting their partner who is studying.

Note that the spousal work permit doesn’t apply to only NOC jobs. This implies that your sponsored partner can work for work on campus as non-academic staff. You can be sure your spouse’s work permit is valid until your study visa expires.

Who is Eligible?

The spousal open work permit will only be issued if the spouse meets the National Occupational Certification (NOC) job types. Also, if the spouse attached to their permit isn’t studying full time, they won’t be eligible for the permit. Therefore, the applicant for the work permit must have a common-law or spouse on a full-time program and possess a valid student permit.

You will also need to provide a relationship proof document showing that your spouse or common-law partner is in a valid relationship. If your partner is processing an Atlantic Immigration Pilot program, then it will be easier to get the work permit approved faster.

If your spouse is military personnel in Canada, they can also apply for a work permit. Also, partners of Canadian representatives in another country can be eligible to apply. Note, however, that any pilot program must agree with the NOC’s standard before a work permit can be given.

When Should You Apply?

You can apply for the spousal open work permit before coming to Canada or after landing. The processing should be done on time if the applicant wants to make good use of their spouse’s study time as it is connected. So, it is best for the applicant to apply before coming into Canada to facilitate quicker processing.

There are so many Canadian visa offices outside Canada and more are being opened to ease the application process. Note that the affiliated center might charge an additional cost if the documents need to be forwarded through them. But this doesn’t apply if the applicant travels to Canada to apply. By visiting your spouse, you can begin the process upon arrival and wait till it is approved. Plus, the visit will help the applicant avoid applying for TRV as the record will not require such.

Atlantic Immigration Pilot (AIP) Work Permit Holders

With this program, your partner can apply for the work permit only if you have a standard NOC skill level job. This program provides faster work permit processing for the regular 12 months.

Bridging Open Work Permit (BOWP) Holders

Those classified as principal Canadian workers are the bridging open work permit holders, and this program also extends to spouses of Canadian international students. Applicants going through this program using FSWC should ensure their spouse doesn’t only have a BOWP but is also working under the NOC standard job procedure.

Provincial Nominee Work Permit (PWP) Holders

If your spouse is a permanent resident, then the stream is best for applying for your open work permit. However, once the spouse’s PNWP expires, it will also affect the applicant’s work permit. Yet the applicant can also attain the status of a provincial resident.

N.B. There is no requirement for legal document proof for conjugal or common-law partnerships.
